PRIVACY POLICY AND TERMS AND CONDITIONS OF USE FOR WEBSITE

By the use of this site you agree to comply with and will be deemed to be bound by these terms, as amended from time to time, and all applicable laws and regulations in connection with the use of the site. If you do not agree to be bound by the current Terms and all applicable laws and regulations, you are required to leave the Site and discontinue use of the Site and services provided on or through the Site.

Among other things, this Site provides general information concerning Rebel’s products. Accessing newsletters or the Dealer Portal requires registration. Rebel reserves the right to refuse to allow registration for or access to the Site or Dealer Portal to any person or entity, for any reason, at any time, in its sole discretion.

These Terms and the information provided on the Site do not modify or supersede and in no way override the terms and conditions of any written agreement or other contract between you and Rebel. IN CASE OF A CONFLICT BETWEEN THE TERMS AND CONDITIONS OF YOUR AGREEMENT AND THESE TERMS, THESE TERMS WILL CONTROL, BUT ONLY WITH RESPECT TO YOUR ACCESS AND USE OF THIS SITE.

You may not use any automatic device, extraction tool, robot, program or technology, or any equivalent manual process, to access, acquire, copy, probe, test or monitor any portion of the Site or Content (as defined below), or in any way reproduce, circumvent or modify the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. Rebel shall have the right, in its sole discretion, at any time and without prior notice, to revise these Terms or to impose new terms and conditions with respect to access to or use of the Site. Such revisions and additions shall be effective immediately upon notice thereof, which may be given by any means, including but not limited to posting the revised or additional terms and conditions on the Site. The date of the last revision of the Terms will appear at the top of these Terms. You are responsible for reviewing the Site periodically for any modification to these Terms. You agree that you shall be deemed to be apprised of and bound by any revisions or additions by Rebel to the Terms. Your continued use of the Site with any such changes to the Terms constitutes your acceptance of the new Terms, whether or not you actually reviewed them. No modification to these Terms by any party other than Rebel shall be valid or enforceable against Rebel unless expressly agreed to by Rebel in writing signed by a duly authorized officer of Rebel.

3. DISCONTINUED OPERATION OF SITE.

Rebel shall have the right, in its sole discretion, without notice and at any time and for any reason to discontinue operation of the Site, or any portion thereof, or any products or services offered through, if any, or advertised on this Site, or to terminate yours or any individual’s access to or use of the Site. Rebel shall also have the right to terminate your access to the Site at any time, in its sole discretion, for any or no reason and in such case you will not be able to access certain features of the Site. The restrictions imposed on you, the disclaimers, indemnities and limitations of liability set forth in these Terms shall survive any termination of the Site or your use thereof.

The Content is provided for informational and promotional purposes only and is not binding on Rebel in any way except to the extent it is expressly provided to be so.

Unless otherwise noted, all Content is protected by copyrights, trademarks, service marks, and other proprietary rights that are owned by Rebel. 5. PRIVACY POLICIES.

When you register on our site to receive information, register for events or newsletters, or otherwise actively provide information to Rebel, we will collect the information that you provide. This may include your first and last name, e-mail address, and other information that you voluntarily provide.

By providing this information to us, you explicitly agree to our collection and use of such information as described in these Terms. We may use your information to respond to your inquiries, process orders, contact you regarding account status or customer service, ask you for feedback on our services, tell you about products or services which may be of interest to you, allow you to access specific account information, or in the case of seeking employment at Rebel, match you with appropriate job opportunities. By registering or otherwise providing information to us, you consent to allow us to contact you for those purposes.

If you provide your e-mail address to us, we may use it to contact you to respond to your inquiries or to provide you with education or information on products or services. We do not knowingly solicit or receive information from children under the age of 18.

We do not sell your personally identifiable information (“PII”) to third parties, nor do we share it with third parties except as described in these Terms. We may share your PII with (a) third party service providers; (b) business partners; (c) affiliated companies within our corporate structure; and (d) as needed for legal purposes. Third party service providers have access to PII only as needed to perform their functions, and they must process the PII in accordance with these Terms.

Examples of how we may share PII with service providers include fulfilling orders and providing services; payment processing and fraud prevention; providing customer support; sending marketing communications; conducting research and analysis; and providing cloud computing infrastructure. We use Google Analytics for collection and processing of data. More can be learned at www.google.com/policies/privacy/partners. Rebel does track its customers over time and across third party websites to provide targeted advertising, and therefore does not respond to Do Not Track (DNT) signals.

Examples of how we may disclose PII for legal reasons include: (a) as part of a merger, sale of company assets, financing or acquisition of all or a portion of our business by another company where customer information will be one of the transferred assets; (b) as required by law, for example, to comply with a valid subpoena or other legal process; (c) when we believe in good faith that disclosure is necessary to protect our rights, or to protect your safety (or the safety of others); (d) to investigate fraud; or (e) to respond to a government request.

We will not disclose your PII to other third parties unless you give us prior consent.

As do many websites, we use “cookies” to enhance your user experience. A cookie is a small piece of data stored on your hard drive containing some demographic information that does not reveal your specific identity. Examples include: zip code, time zone, user preferences, web visits, IP address, browser and device information, domain name and referring website.

These Terms, and any disputes of any kind between you and Rebel, shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflicts or choice of law’s provisions. Sole and exclusive jurisdiction for any action or proceeding arising out of, or related to, these Terms, use of this Site shall be in the state courts located in the County of Medina, Ohio, or the United States District Court for the Northern District of Ohio. The section titles in this Terms and Conditions of Use are for convenience only and have no legal or contractual effect.
